Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of TCG Stack — the website at tcgstack.com and our mobile apps (together, the "Service"), operated by TCG Stack (ABN 92 676 083 630) ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and your account

You must be at least 13 years old to use the Service. You are responsible for the accuracy of the information you provide, for keeping your password secure, and for all activity under your account. Notify us promptly of any unauthorised use.

You may delete your account at any time from within the app. On deletion, your personal data and collection data are removed as described in our Privacy Policy.

3. The Service

TCG Stack lets you catalogue and manage trading card game collections and view market-price information. Market prices, estimated values, and price history are estimates for informational purposes only, derived from third-party sources and sold-listing data. They are not appraisals or financial, investment, or trading advice, and we do not guarantee their accuracy, completeness, or timeliness. Do not rely on them for buying, selling, or insurance decisions.

We may add, change, or discontinue features at any time.

4. Subscriptions and billing

Premium is an optional paid subscription offered on a monthly or annual basis. Subscriptions auto-renew at the then-current price at the end of each billing period unless cancelled beforehand. The price, length, and renewal terms are shown at the point of purchase.

Web (Stripe). Subscriptions purchased on the web are billed through Stripe. You can cancel at any time from your account settings; cancellation stops future renewals and access continues until the end of the current paid period.

Apple (App Store). Subscriptions purchased through our iOS app are billed by Apple and managed by you in your App Store account settings. We cannot cancel or refund an App Store subscription on your behalf — you must manage it via Settings → your name → Subscriptions.

Refunds. Except where required by law (or, for App Store purchases, at Apple's discretion), payments are non-refundable, including for partial periods. If you delete your account, we cancel your Stripe subscription immediately with no further charges; App Store subscriptions must be cancelled by you in the App Store.

We may change subscription prices; we will give notice before a price change takes effect, and continued use after the change constitutes acceptance.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in breach of these Terms.
• Access, scrape, or harvest the Service or its data by automated means, or attempt to circumvent rate limits, authentication, or security.
• Interfere with, disrupt, or place undue load on the Service or its infrastructure.
• Reverse engineer, resell, or commercially exploit the Service except as expressly permitted.
• Upload malicious code or infringe the rights of others.

6. Your content

Your collection data is yours. You grant us a limited licence to store, process, and display it solely to operate and provide the Service to you (for example, to compute collection values and sync across your devices). You are responsible for the content you add and confirm you have the right to add it.

7. Intellectual property

The Service, including its software, design, and branding, is owned by us and protected by intellectual-property laws. These Terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial collection management.

Trading card names, images, logos, and related content are the property of their respective owners. TCG Stack is an independent collection-management tool and is not affiliated with, endorsed by, or sponsored by any card game publisher, distributor, or marketplace.

8. Third-party services

The Service relies on third-party providers (for example, for catalogue and price data, payments, authentication, and email). We are not responsible for third-party services, and their availability or data is not guaranteed. Your use of certain features may be subject to those providers' terms.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, and any warranty as to the accuracy or reliability of prices or estimated values. We do not warrant that the Service will be uninterrupted, secure, or error-free. Nothing in these Terms excludes any rights or guarantees you have under applicable consumer-protection law that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Service. To the extent our liability cannot be excluded, it is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

Where our liability for a breach of a consumer guarantee under the Australian Consumer Law cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the Service (or the relevant part of it) or paying the cost of having it resupplied.

11. Suspension and termination

We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

12. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them. Nothing in this section limits any rights you have under the Australian Consumer Law or other laws that apply to you and cannot lawfully be excluded.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, for significant changes, notify registered users by email. Your continued use of the Service after changes take effect constitutes acceptance.
